This option is attractive for corporations with water rights. If a corporation or a business trust with associate status sells water rights and makes a profit it pays taxes at its corporate rate. When the proceeds are distributed to shareholders as dividends, the proceeds are taxed again at the taxpayer rate. By utilizing Section 1031(a) of the Internal Revenue Code shareholders can receive payments directly thereby subjecting the proceeds to taxation once.
